These Terms of Service ("Terms") form a binding agreement between you and Ishan Jaiswal ("we", "us", "our", "the Owner"), the independent individual operator of Ovels and its dashboard/wiki website (together, the "Service"). By inviting Ovels to a Discord server, using any of its features, or signing in to the dashboard, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you are acting on behalf of a Discord server or organization, you confirm you have authority to bind that server to these Terms, and "you" refers to both you individually and that server.
If you do not agree to these Terms, do not add, access, or continue using the Service, and remove it from any server you control.
Ovels is a Discord bot providing moderation, automod, ticketing, giveaways, reaction roles, counters, music playback, and button-based minigames, together with a web dashboard for configuring these features. The Service is developed and operated independently and is not affiliated with, endorsed by, or operated by Discord Inc. "Discord" is a trademark of Discord Inc.
You must meet Discord's own minimum age and account eligibility requirements, and comply with Discord's Terms of Service and Community Guidelines, to use the Service. We reserve the right to refuse or restrict access to the Service for any user or server, at our sole discretion, including where we reasonably believe eligibility requirements are not met.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose within your Discord server(s). All software, source code, branding, logos, and content that make up the Service remain the exclusive property of the Owner (or the Owner's licensors) and are protected by applicable intellectual property laws. Nothing in these Terms transfers any ownership right to you. You may not copy, reverse-engineer, resell, sublicense, or create derivative works from the Service except where you hold separate, explicit written permission from the Owner.
You agree not to: use the Service to violate any applicable law or Discord's Terms of Service/Community Guidelines; attempt to exploit, abuse, overload, reverse-engineer, or disrupt the Service's infrastructure; use the Service to harass, threaten, defraud, or harm any person; circumvent moderation, automod, or rate-limit systems; use automated means to interact with the Service outside of Discord's own permitted API usage; or misrepresent your identity or authority when configuring the dashboard. We may investigate suspected violations and take action including warnings, feature restriction, or termination as described in Section 13.
Ovels is a configurable tool. Server owners, administrators, and moderators are solely responsible for how they configure and use the Service — including automod thresholds, ticket handling, giveaway rules, and any warning, mute, kick, or ban issued through the bot. The Owner does not control, review, or endorse individual server configurations or moderation decisions, is not a party to disputes between server members or between a server and its members, and accepts no responsibility for the outcome of any moderation action taken using the Service.
The Service is currently provided free of charge. We reserve the right to introduce optional paid plans, subscriptions, or add-on features at any time in the future, at prices and terms we determine, with reasonable advance notice communicated through the Service or its official channels. Introduction of paid features will not retroactively obligate existing free-tier users to pay, and these Terms will be updated to describe billing, cancellation, and refund terms before any payment is collected. Except where required by applicable law, payments (once introduced) will be non-refundable.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED/ERROR-FREE OPERATION. WE DO NOT WARRANT THAT THE SERVICE WILL BE AVAILABLE AT ALL TIMES, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOU USE THE SERVICE ENTIRELY AT YOUR OWN RISK.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: THE OWNER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, REVENUE, GOODWILL, OR PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS INCLUDES, WITHOUT LIMITATION, DAMAGES ARISING FROM: SERVICE OUTAGES OR DOWNTIME; MODERATION ACTIONS TAKEN BY ANY SERVER'S ADMINISTRATORS OR MODERATORS USING THE SERVICE; DISPUTES BETWEEN SERVER MEMBERS; LOSS OR CORRUPTION OF SERVER CONFIGURATION OR DATA; THIRD-PARTY SERVICES (INCLUDING DISCORD) BEING UNAVAILABLE, CHANGED, OR TERMINATED; OR UNAUTHORIZED ACCESS TO YOUR DATA NOT CAUSED BY OUR GROSS NEGLIGENCE.
IN ANY EVENT, AND TO THE FULLEST EXTENT PERMITTED BY LAW, THE OWNER'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO THE OWNER FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE THOUSAND INDIAN RUPEES (₹1,000). BECAUSE THE SERVICE IS CURRENTLY FREE, THIS MEANS THE OWNER'S LIABILITY IS, TO THE EXTENT PERMITTED BY LAW, LIMITED TO THAT NOMINAL AMOUNT FOR ALL FREE-TIER USE.
Some jurisdictions do not allow the exclusion or limitation of certain damages or implied warranties; in such jurisdictions, our liability is limited to the smallest extent permitted by applicable law.
You agree to indemnify, defend, and hold harmless the Owner from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: your use or misuse of the Service; your violation of these Terms, applicable law, or Discord's Terms of Service; content you submit or actions you take through the Service; or moderation decisions made by your server's administrators or moderators using the Service.
The Service depends on Discord's platform and other third-party infrastructure and API providers that are outside our control. We are not responsible for the availability, accuracy, security, or policies of these third-party services, and any interruption, change, or termination of access by such third parties (including Discord suspending or removing the bot's application) may affect or end your ability to use the Service, without liability to us.
We may suspend or terminate your (or your server's) access to the Service, in whole or in part, at any time, for any reason or no reason, with or without notice, including for suspected violation of these Terms. You may stop using the Service at any time by removing Ovels from your server(s). Sections of these Terms that by their nature should survive termination (including Sections 4, 9, 10, 11, 16, and 17) will survive.
We may modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms from time to time; the "Last updated" date above reflects the latest revision, and material changes will be posted on this page. Your continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
We are not liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, internet or hosting-provider outages, Discord platform outages or policy changes, power failures, cyberattacks, or governmental action.
These Terms, and any dispute or claim arising out of or in connection with them or the Service (including non-contractual disputes), are governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles.
You agree that any dispute, claim, or controversy arising out of or relating to the Service or these Terms shall be subject to the exclusive jurisdiction of the competent courts at Varanasi, Uttar Pradesh, India, and you irrevocably submit to that jurisdiction and waive any objection to venue there, including on grounds of inconvenient forum. Nothing in this clause prevents either party from seeking urgent injunctive relief from a court of competent jurisdiction where necessary.
Severability: if any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect, and the unenforceable provision will be interpreted to best reflect its original intent. No waiver: our failure to enforce any right or provision is not a waiver of that right. Entire agreement: these Terms, together with the Privacy Policy, constitute the entire agreement between you and the Owner regarding the Service and supersede any prior agreements. Assignment: you may not assign or transfer these Terms without our written consent; we may assign these Terms in connection with a transfer of the Service's operation. Independent operator: the Service is operated by an individual, not a registered company; references to "we"/"us"/"our" refer to the Owner acting in that individual capacity.
